Terms of use
1. Acceptance of these terms
By downloading or using Hum: Sleep, Focus & Lofi Music ("the app"), you agree to these terms. If you do not agree, do not use the app. The app is made by Winton Gee ("we" or "us"). It plays original instrumental music, organized into stations, for sleep, focus and calm.
2. Not medical advice and not a medical device
Hum is a music and relaxation app. It is not a medical device and makes no health claims.
- It is not intended to diagnose, treat, cure or prevent any disease, sleep disorder or medical condition.
- If you have a sleep disorder or a medical concern, talk to a qualified healthcare professional.
3. Music license
All music in Hum is original to Hum. It was generated with Google's Lyria model and mastered by us. It is licensed to you for personal, non-commercial listening within the app only. You may not copy, extract, redistribute, broadcast, publicly perform or otherwise use the music outside the app.
4. Eligibility and requirements
- You must be at least 13 years old to use the app.
- The app runs on iPhone with iOS 26 or later.
5. Free listening and Hum+
Every station and feature is free for up to 90 minutes of listening a day; the allowance resets at midnight, local time. Hum+ removes the daily limit. Both plans start with a 1-week free trial for eligible new subscribers: nothing is charged during the trial, payment is charged to your Apple Account when it ends unless you cancel at least 24 hours before, and any unused part of a trial is forfeited when you buy a subscription. Hum+ is available as:
- Hum+ Monthly: an auto-renewing subscription, $4.99 a month in the US (prices vary by region)
- Hum+ Yearly: an auto-renewing subscription, $50.99 a year in the US (prices vary by region)
Subscription terms
- Payment is charged to your Apple Account when you confirm the purchase.
- Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the period ends.
- You can manage or cancel the subscription in Settings > [your name] > Subscriptions. Canceling stops the next renewal; the subscription stays active until the end of the period you paid for.
- Refunds are handled by Apple under its policies.
6. Apple's standard license
The app is licensed to you under Apple's Licensed Application End User License Agreement (opens in a new tab), together with these terms. If the two conflict, Apple's agreement applies to the license. Apple is not responsible for the app or its content and has no obligation to provide maintenance or support for it.
7. Your data
Your favorites, settings and daily listening count are stored only on your iPhone and do not sync to other devices. Deleting the app deletes them. See the privacy policy for details.
8. Disclaimer of warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. We do not warrant that the app will be uninterrupted or error-free, that the app will improve your sleep, focus or any health outcome, or that defects will be corrected.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WINTON GEE IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING DAMAGES ARISING FROM LOSS OF USE OF THE APP OR LOSS OF DATA. Our total liability for any claim related to the app is limited to the amount you paid for it in the 12 months before the claim.
10. Intellectual property
The app, including its design and content, is owned by Winton Gee and protected by copyright and other laws. You may not copy, modify, distribute or reverse engineer it, except as the law allows.
11. Changes to these terms
We may update these terms. The new version will be posted on this page with a new effective date. Using the app after that date means you accept the updated terms.
12. Governing law
These terms are governed by the laws of the State of California, United States, without regard to its conflict of law rules. If any part of these terms is found unenforceable, the rest stays in effect.
